1. GENERAL INFORMATION

These Terms and Conditions govern use of website diamante.live and purchase of products from eCommerce Store managed by Ass. Culturale Officina Del Territorio. By using Site and services, user fully accepts these Terms.

2. SERVICES OFFERED

DIAMANTE is a digital ecosystem offering: eCommerce Store (Made in Italy products), TV/Streaming (Italian cultural content), Community, gamification system, educational content. These Terms apply primarily to eCommerce Store.

3. REGISTRATION AND ACCOUNT

3.1 Account Creation

To make purchases, account creation required providing: first and last name, valid email address, secure password, date of birth.

3.2 Minimum Age

Minimum registration age is 16 years (EU) or 13 years (USA). Users between 13/16 and 18 years must have parental or guardian consent.

3.3 User Responsibilities

User is responsible for: providing truthful and updated information, keeping login credentials confidential, notifying immediately of unauthorized access.

4. PRODUCTS AND PRICES

4.1 Product Description

Product descriptions are provided accurately. Colors may vary slightly due to screen settings. Measurements may have tolerances of 1-2 cm. Handcrafted products may present slight differences.

4.2 Availability

Availability is indicated on Site and regularly updated. In case of stock-out after order, customer will be contacted within 48 hours to choose alternative product or refund.

4.3 DDP Pricing

All prices are in DDP (Delivered Duty Paid) mode and include: product price, international shipping, VAT (where due), customs duties (where due), customs clearance. Displayed price is final price. No additional costs upon delivery.

4.4 Price Variations

Prices may vary without notice. Price applied is that valid at time of order confirmation.

5. ORDER AND PAYMENT

5.1 Order Procedure

Add products to cart, proceed to checkout, enter shipping and billing details, choose payment method, review and confirm order.

5.2 Order Confirmation

After payment, customer will receive order confirmation email with order number, product summary and amount, billing details. Contract is concluded at time of order confirmation.

5.3 Payment Methods

Accepted methods: credit/debit cards (Visa, Mastercard, American Express), PayPal, bank transfer (only orders over 500 euros), Apple Pay, Google Pay. Payments processed through PCI-DSS certified gateways.

5.4 Invoicing

Electronic invoice (if requested) will be sent via email within 5 business days of shipment.

6. SHIPPING AND DELIVERY

See Shipping Policy for complete details. Summary: order processing 7-10 business days, global shipping with DDP, tracking always provided, no costs upon delivery.

7. RIGHT OF WITHDRAWAL AND RETURNS

Customer has 14 days to exercise right of withdrawal without reason. Return is free with return shipping costs fully borne by seller. See Refund and Return Policy for complete procedure.

8. LEGAL GUARANTEE

All products are covered by 24-month legal conformity guarantee (Consumer Code, articles 128 et seq.).

8.1 Conformity Defects

Within 6 months of delivery, defect is presumed to exist at time of delivery. After 6 months, user must prove defect existed at delivery.

8.2 Remedies

Customer may request, in order: product repair, product replacement, price reduction, contract resolution (refund).

9. INTELLECTUAL PROPERTY

All intellectual property rights related to the DIAMANTE brand, including but not limited to trademarks, logos, trade names, website content (texts, images, videos, graphics, software), and all related materials, are the exclusive property of the Rights Holder.

Ass. Culturale Officina Del Territorio operates this website and eCommerce Store under an exclusive license granted by the Rights Holder for the use of such intellectual property.

Any unauthorized use, reproduction, distribution, modification, or copying of intellectual property by third parties without written authorization from the Rights Holder is strictly prohibited and subject to legal action.

9.1 Trademarks

The trademark "DIAMANTE - The Italian Culture Empire" and all related logos, graphics, and trade names are the exclusive property of the Rights Holder. Prohibited activities include: use of trademarks without written authorization, registration of similar domains or trade names, creation of confusion with the DIAMANTE brand.

9.2 Site Contents

All content published on diamante.live is protected by copyright and owned by the Rights Holder. Prohibited activities include: copying, reproduction, or distribution without authorization; scraping or automatic data extraction; reverse engineering of the site; unauthorized commercial use.

10. LIMITATION OF LIABILITY

Seller is not liable for: temporary Site interruptions for maintenance, third-party technical issues (carriers, payment gateways), customs delays or force majeure events, indirect damages. Liability is limited to purchased product value.

11. PRIVACY AND DATA PROTECTION

Processing of personal data is governed by Privacy Policy, compliant with GDPR, CCPA, LGPD and other international regulations.

12. DISPUTE RESOLUTION

12.1 Applicable Law

These Terms are governed by Italian law.

12.2 Competent Court

·       For consumers residing in the European Union, the competent court is that of the consumer's place of residence.

·       For all other consumers (Extra-EU) and B2B disputes, the exclusive court is Teramo, Italy.

13. CHANGES TO TERMS

Seller reserves right to modify these Terms at any time. Substantial changes will be notified via email with 30 days notice and Site banner. Continuing to use Site after changes, user accepts new Terms.
